Question for Andy & Team:
If we’re interested in making an offer on one of your listings, can we also use you to represent us as buyers?
Is this legal and proper in Florida?
Is it advisable?
Please also explain the duties and responsibilities of a “transaction broker”.

Thank you for your thoughtful question. In Florida, the law does not allow “dual agency,” where one agent represents both buyer and seller with full fiduciary duties. Instead, Florida permits what’s called a transaction broker relationship.
As transaction brokers, we can legally assist both parties in the same transaction. Our duties include dealing honestly and fairly, accounting for all funds, using skill and diligence, disclosing material facts, presenting offers promptly, and maintaining limited confidentiality. What this means is that we act as facilitators rather than advocates—we help both sides move the transaction forward, but we do not provide undivided loyalty to either party.
This arrangement is common and proper in Florida. Whether it’s advisable depends on your preference: some buyers appreciate the efficiency of working directly with the listing team, while others prefer having a separate agent to advocate solely for them. We’re happy to discuss your comfort level and make sure you feel fully informed before moving forward.
